<p>This book presents a proposal for a new soft computing innovative method called by “CFE” forevaluation of the football matches of FIFA(IFAB) and UEFA to compute the true ‘Winner’. It is a research work in the area of ‘Football Science’, being proposed to FIFA (IFAB) and UEFA, Zurich, Switzerland for consideration to replace the existing obsolete and weak rules of football matches of 90 minutes to declare the final ‘Winner’. In CFE, the final decision about any football match of 90 minutes is obtained “by computation”, by execution of a software called by ‘CFE-software’ with the real time input values directly from the field on a number of highly significant parameters, some of them being continuous variables. The result of m-n goals at the end of 90 minutes play in a football match is just one of the many parameters for the computation of the ‘Winner’ in our proposed CFE method. The evaluation is mainly based upon the application of Fuzzy Logic, ‘Fuzzy Pocket Machine’, fast ComputerServer, good Communication system from playing-field to the server (as used in Cricket matches) and the CFE-software at the server. Nonostante l'importanza delle attivit? da loro svolte, la regolamentazione degli agenti sportivi tanto nell'ordinamento giudicio ordinario come nell'ordinamento sportivo, ? assolutamente carente. Ad esempio, in alcuni paesi comunitari, viene attribuita agli agenti un'obbligazione di risultato, mentre in altri ordinamenti giuridici europei, gli stessi devono rispondere verso il proprio cliente solamente di un'obbligazione di mezzi. Parimenti, tanto l'ordinamento giuridico ordinario, come l'ordinamento sportivo, non richiedono perlopi? nessun titolo scolastico o accademico per esercitare l'attivit? di agente. A partire dagli anni novanta, la FIFA, l'associazione internazionale di amministrazione del calcio, ha pubblicato numerosi regolamenti relativi al settore degli agenti. Negli anni 2000 la FIFA era riuscita a garantire la qualit? dei servizi prestati dagli agenti FIFA che, per poter conseguire la licenza di agente, dovevano superare un esame. Tuttavia, nel 2015, con la pubblicazione del "Regulations on Working with Intermediaries", la FIFA decise di attribuire la competenza per il rilascio delle licenze di agente sportivo, alle singole federazioni nazionali, annullando quanto di buono era stato fatto nel ventennio precedente. Dal 2015 il precedente titolo di agente Fifa, che permetteva di esercitare l'attivit? di agente in tutto il mondo senza limitazioni, non esiste pi? ed attualmente ? possibile registrarsi soltanto presso una federazione nazionale. Di conseguenza, ad oggi se un agente francese volesse effettuare un'operazione di mercato in Italia, dovr? registrarsi presso il registro federativo nazionale italiano, poich? il contratto del giocatore sar? registrato in Italia. Il risultato scaturito dalla decisione adottata nel 2015 dalla FIFA, ? stato quello di una grande diseguaglianza tra i regolamenti nazionali degli agenti sportivi di tutto il mondo. Ad oggi infatti, alcune federazioni esigono l'approvazione di prove scritte ed orali per l'ottenimento della licenza di agente, mentre altre federazioni comunitarie ed extracomunitarie, richiedono solamente il pagamento della corrispondente tassa d'iscrizione. Allo stesso modo, alcune federazioni hanno aggiornato e modificato pi? volte il proprio regolamento, mentre altre federazioni nazionali si sono limitate ad emanare un regolamento attuativo del Regulations on Working with Intermediaries nel 2015 senza mai aggiornare le proprie disposizioni. Dal punto di vista giuridico, il regolamento adottato nel 2015 dalla FIFA, rappresenta solamente un insieme di raccomandazioni prive di qualsiasi natura giuridica vincolante. Le commissioni per gli agenti stabilite nel citato regolamento infatti, vengono fissate al 3% rispetto al prezzo del trasferimento pagato dal club acquirente o rispetto allo stipendio percepito dal calciatore, ma tale limite, non ha carattere vincolante n? imperativo, pertanto gli agenti non sono obbligati a rispettarlo. Dal canto suo, la stampa nazionale ed internazionale alimenta la confusione che circonda il settore degli agenti, concedendo notoriet? a soggetti estranei all'ordinamento sportivo, qualificandoli come procuratori o perfino come "agenti FIFA", nonostante tale titolo non esista pi? dal 2015. Anche i controlli delle federazioni nazionali e della FIFA stessa non sono stringenti: ? possibile perfino incontrare in internet corsi a pagamento per diventare agente FIFA.
